STATEMENT OF CREDENTIALS

Credential Statement
Cecil G. Daniels, e-Pro, GRI

  1. I am over the age of eighteen (18) and a resident of Maricopa County, Arizona. 

  2. I am a licensed real estate broker in Arizona and have been continuously licensed in Arizona since 1981.  Prior to that date I was licensed in Illinois and California In the aggregate, I have been licensed a total of thirty eight years (38).
  3. Since 1983, I have owned and operated a fully accredited School of Real Estate offering Courses in Sales and Broker Pre-Licensing, Continuing Education as required by Arizona license law and a Senior Instructor with the Arizona Association of REALTORS in the Graduate REALTOR Institute (GRI).

  4. I have earned and maintained the Master in Real Estate (MRE) issued by the Arizona Association of REALTORS as a result of industry contributions and acquiring three times the Continuing Education required by Law to renew a Broker’s License.

  5. I have served on the Arizona Association of REALTORS Professional Standards Committee, which measures REALTOR conduct in their duties to the Public, the Client and each other.  Within the same structure I serve on panels that resolve economic disputes under the Policies of the REALTOR guidelines for Arbitration.

  6. I have provided testimony as an expert in Depositions, Arbitration and trial.  In addition, attorneys will occasionally utilize my services as a consultant on various issues that may concern pending litigation.

  7. I have offered expert testimony for both plaintiffs and defendants that involve Standard of Care, Broker Duties, Agency Relationships and misrepresentation, fraud and breach of duty in real estate disputes. 
     
  8. Since 1986, I have been a part of the development of standard forms at the State level including the Residential Real Estate Purchase Agreement, Agency Disclosure Form, Seller’s Property Disclosure Statement, and Consent for Limited Representation, Buyer Broker Agreement and other related forms. 

  9. On numerous occasions I have served in various advisory capacities to four Real Estate Commissioners including educational issues.  Most currently on the Education Advisory Committee.  The objective for this group is to evaluate education and as necessary suggest various Statutes, Rules and Policy of the Department of Real Estate on matters of education.  
     
  10. I have personally sold over $250 million of residential property in addition to approximately 80 million in commercial property.

  11. In 1996, the National Association of REALTORS, consisting of some 900,000 members at the time, named me as the Educator of the Year as a result of my contributions to the industry.

  12. I specialize in the development and delivery of courses under the heading of Risk Management which includes Contract Law, Agency Relationships, Real Estate Legal Issues, Disclosure, Commissioner’s Standards and Broker Management which are all required Core Courses mandated by the Arizona Department of Real Estate.  In addition I am certified to offer courses on the REALTOR Code of Ethics and other required Continuing Education course work.  Professional organizations that cater to educators have frequently invited me to develop or participate in Instructor Development Workshops. 

  13. In November of 2004, I received Certification as a trainer of e-PRO, a National Association of REALTORS Certification on technology applications in the real estate industry. 

  14. I received National Certification as a Train the Trainer for ZIPFORM a State Specific computer Program that encompasses a wide range of applications for all Arizona Association of REALTORS Forms.

  15. I offer consulting services to brokers throughout the State of Arizona on Management Principles, Office Policy and Procedures, relationships between broker and agent, Risk Management and certified to teach a broker audit clinic that has been required of brokers to attend in order to renew their license.
  16. With the credentials stated above, I submit the following opinions based upon the information that has been provided to me to date together with the REALTOR Code of Ethics, The Commissioner’s Rules and Regulations, ARS Title 32 Chapter 20 and my knowledge of the applicable Standards of Care.
